COMPETENCE
One of the most important things we offer is "Extensive, Extended Fact Pleading" on all Pleadings.
We do... in written form, what we always ask our witnesses to do... paint a picture with your words... tell the whole story...
The bare elements of a claim may be enough to legally, sustain a demand, but we do not believe "things just happen".
We want all of the circumstantial, back ground data, and a full, point by point, description of each and every event.
This type of work results in a writing which offers the following advantages to you and your file.
A.
Because it is in written form, the Judge will often
read it prior to or after the hearing, getting more than one exposure,
as well as more time to better grasp our view, theories, and version of the facts.
B.
Because it is in written form it's now in documentary existence, and
"there", as a "smoking gun", leaving a paper trail, so no one can say they were not informed.
C.
Your whole story, is now told to anyone who desires to read the
public record, at any later time.
D.
It has the tendency of creating a desire in the other side to settle the case in order to keep these matters from
coming out in open court, in a hearing at a later time, if there is no settlement.
E.
It has significant, administrativ, advantages including but not limited to the following:
(1)
It creates an already prepared factual brief.
(2)
It creates a trial memorandum with witness and exhibits list.
(3)
It clearly lets the client know, well in advance, what we need to prove so that we have time to arrange strategy
concerning, how we will prove it.
(4) It creates an
interchangeable file so that any attorney can pick it up and be
prepared at anytime.
(5)
It creates an appellate brief in case we lose at trial court level.
The last most importnat concern at Signature Hill and again in our law office in my individual discipline, is competence.
You should ask your attorney what experience he has in the area in
question that you are looking at. You should ask the attorney how many files he has done of that nature.
Also, in this competent issue, it is vitally important for us to demonstrate to you that it is our desire at all times
to go beyond the minimal levels of competence recquired for licensure and push the envelope. We desire to keep on
learning and keep on adding information to what we do for a living. In terms of competence, we hope that you take note of
the facility in which you are in, how conducive is it to the business atmosphere that's required, including our equipment
commitment. At Signature Hill, we pride ourselves on having made a major financial commitment to state of the art
equipment. Sometimes, there's literally a blizzard of paper involved in litigation. We are not all that happy with this
reality, either, but the bottom line is we've got to have the facilities and equipment to get you to court quickly, to
best position you for leverage for either ultimate success or (again) a well-rounded, well-negotiated, in-between
settlement. We have a staff who will work diligently with you, (the client) always, uppermost in mind.
Ask your attorney what strategy moves he plans on making. We will, during
client orientation, attempt to show you what strategy moves we are going to chose to accomplish your short, long and
intermediate range objectives and then we will also to endeavor to show you (how) we will implement that strategy,
specifically, what things we will do to get that strategy thereby set the agenda into action for you.
Additionall in this competence area, it is very important for you to analyze your prospective attorney and (especially)
our office here at Signature Hill in terms of demeanor of the
professional. Not only are there planned strategy moves and procedures to initiate them, but the demeanor of the
advocate who implements them, and takes them to court, is important. It's a communication business.
If your file has merit and if we have put it together in paper correctly, we need somebody to communicate it formerly
and clearly for not only a judge or jury but whoever else may be involved in the vital decision making process.
Also, Signature Hill, we're no stranger to the appellate court system.
It's important for you to ask your prospective attorney whether he has ever been in the appropiate appellate court
system. It's important for you to know whether or not your attorney is able and willing to create the necessary record,
and go into the appropiate appellate courts, if necessary, to stay with your vitally important issue.
We also do accident litigation. One of the free public services we offer is, taking your car insurance policy and
examining it, so that you will know if there are any shortfalls and any areas we think should be looked at in case
something happens, prior to you finding out the hard way, after an accident. Also, we do custody litigation, criminal
law, we do estate planning, simply stated, we are a full service law office here.
Lastly, as with Signature Hill Professional Consultants, we will find you an attorney, with some restrictions, who will
work in an area that he has experience in academically and/or geographically.
We will either go to all 67 counties, 50 state, and several countries or, with some restrictions, help you find a
like-minded professional. We recognize that the world is shrinking and litigation knows no jurisdictional limits.
Rest assured that the same features of integrity, work ethic, and competence will be diligently pursued if we have to
you or work with another practitioner in another jurisdiction.
In closing, I hope that you get through this difficult time, and I hope more importantly... that you understand that
we care. I wish you and your family all the best.
