     As I stated earlier, I am a father of three, grandfather, former teacher/ coach, former assistant high school principal, former prosecutor, and current defense attorney.

     I first became involved in substance abuse issues as a very aggressive and much younger prosecuting attorney in Lawrence County Pennsylvania having successfully convicted several persons, for drug and alcohol violation.

      Using these tools since then, I have turned legal problems into health solutions and; saved children from loosing their mother to the state penitently; saved a college career and scholarship in a local university; saved a nurse and mother from loosing her freedom and her children; and significantly reduced criminal sanction in several other cases (while) requiring the defendant to become involved in an early intervention, no-nonsense treatment strategy.

     We have turned the power of the law into a friend and have successfully used it to drive a health solution.

     Over the past several years we have worked closely with Dr. Robert Woolhandler, a dedicated, hard working, family oriented, addiction physician. During those years, we have noted and documented several very important supporting observations:

NEW PHARMACOLOGY

1.      History has never known recent breakthroughs in science, which have created the real power to say no and mean it. An addiction physician, after proper intake data is assembled,(now) has pharmacological tools which will enable the prescribing of two FDA approved, medications: (1) which will painlessly detox the patient, and a second (2) which will block the abuser of the effects of drugs or alcohol.

IDENTIFYING AND SORTING PROPERLY MOTIVATED SUBJECTS

2.      Sorting out properly motivated people can pay big dividends for society and the patient. Achieving success in the battle with addiction is directly related to the motivational level of the patient and his family or friends.

      Currently, approximately 75% of all incarcerated persons in the state of Pennsylvania are in for drug-and alcohol related offenses. Approximately 90% of incarcerated females are in for drug-and alcohol related offenses.

     We believe some attention should be paid to sorting out criminal cases from health cases. Although we do not condone or excuse that illegal use of, or the illegal obtaining of legal or illegal drugs, we believe in many of the cases the necessary criminal (culpable mind set) is often lacking. In the purest sense of the analysis many people were innocently addicted, and do not repeat to have fun, or because they are not law-abiding citizens, but because they have a health compulsion which is bigger than their strength to stop on their own.

      We believe there is a moral imperative, to do a much better job of sorting these persons out of the criminal population. These figures, translate into a staggering impact on our state economies. The cost to inhabit a prisoner is at least $37 per day, to say nothing of the lost revenue from last withholding taxes of incarcerated persons who cannot work while they are in jail.

     You do not need a professional degree, to understand that bad habits are very hard to break; drug and alcohol related habits are the toughest habits to break.

     The Honorable Michael Barasse currently the president of the National Drug Court Association and a leading jurist in substance abuse from eastern Pennsylvania has stated publicly on numerous occasions, that “an addict or an alcoholic doesn’t merely wake up one morning, and decide that today is the day that I am no longer going to be an addict.”

     The power of the law and imminent criminal proceedings, many times will drive a defendant to finally address the treatment strategies. 

     Although our office has always been academically offended by objective, mechanical, non-human, inflexible sentencing apparatus like mandatory minimums, we do recognize a time sensitive, priceless, and unique opportunity if the legal and medical professions could be combined to work together, within this time period.

     A person who is about to lose their freedom has a very intense motivation to recover.

     Similar observations exist in the workplace. A current phenomenon known as “presentisim” (a worker who is present but not being productive, and also jeopardizing the health and safety of others) costs employers dearly. People who are about to lose a career, or companies who are about to lose a very important employee have a significantly enhanced possibility for success, if all of the tools are used at the right time.

     The common re-occurring theme is sorting out the properly motivated person, and implementing or team approach for start intermediate and long-range goals.

3.      Although the many diversified dimensions which make up the total human being can create multiple challenges, it likewise can be made to provide multiple opportunities for success. The diversity of my background, taught me a long time ago that a person is a total human being.

     We have determined that the best way to provide services to a substance-abuse person, is to draw upon all of those basic needs after proper assessment.

     The first challenge was, for us to assemble a relevant, diversified group of professionalism academic areas as follows:

4.      Even the best group of ballplayers on a baseball team, or musicians in an orchestra are not effective at all, unless they are playing off of the same playbook or sheet music, with an agreed upon central manager or conductor.

     We needed to adopt a uniform plan or protocol, which still provided complete independence to each of the professionals, but an agreed upon designated goal. In this case the required goal is non negotiable total abstinence compliance of which must at all times be assured through standardized binding legal obligations and proven by high technology scientific evidence.
